If a collection agency contacts you about a debt, do not assume it is correct or even yours. Under the Fair Debt Collection Practices Act, you have the right to demand they validate the debt before you pay a cent. Collectors buy old debts in bulk, and errors and mix-ups are common.

What debt validation means

A debt validation letter asks the collector to prove, in writing, that the debt is real and that they have the right to collect it. You can ask for the original creditor, an itemized amount owed, proof they own or are authorized to collect the debt, and a copy of any signed agreement.

Until they validate, you can request that they pause collection activity and stop reporting the account to the credit bureaus.

When and how to send it

Send your validation request promptly, ideally within 30 days of first contact, when your rights are strongest. Send it by certified mail and keep a copy. Direct all further communication to be in writing.

If the collector cannot validate the debt, they should not be collecting on it or reporting it. If they can, you then know exactly what you are dealing with and can decide your next move.

Validation guards against paying a debt that is not yours, is past the statute of limitations, or has already been paid. It also slows down aggressive collectors and creates a paper trail.
